What the section does

  • Personal data is any data about an individual who is identifiable by or in relation to that data: a name, a phone number, an email address, a photograph, an employee record.
  • The business that decides why and how personal data is processed is the Data Fiduciary and carries the Act's duties. A vendor that processes on its behalf is a Data Processor, and section 8(1) keeps the Data Fiduciary responsible for what the processor does.
  • The Data Principal is the person the data is about. For a child, anyone under eighteen, it includes the parents or lawful guardian; for a person with disability, her lawful guardian acting on her behalf.
  • A personal data breach is wider than a hack: any unauthorised processing, or accidental disclosure, acquisition, sharing, use, alteration, destruction or loss of access, that compromises confidentiality, integrity or availability.

Where people go wrong

  • Thinking personal data means sensitive data. The Act has no separate sensitive category: any data about an identifiable individual is personal data.
  • Assuming the vendor is the one responsible. The Data Fiduciary stays responsible for processing a Data Processor does on its behalf.
  • Reading "breach" as only a cyber attack. An email sent to the wrong person, a lost laptop or an over-shared spreadsheet can each be a personal data breach.
  • Using a lower age for a child because another regime does. Under section 2(f) a child is anyone who has not completed eighteen.

Common questions

What is personal data under the DPDP Act?

Under section 2(t), any data about an individual who is identifiable by or in relation to such data. The Act applies to it when it is in digital form, or is digitised later (section 3).

What is the difference between a Data Fiduciary and a Data Processor?

A Data Fiduciary determines the purpose and means of processing (section 2(i)); a Data Processor processes personal data on its behalf (section 2(k)). The duties under the Act fall on the Data Fiduciary, which remains responsible for its processors under section 8(1).

Who is a Data Principal?

The individual the personal data relates to (section 2(j)). Where she is a child, the term includes her parents or lawful guardian; where she is a person with disability, her lawful guardian acting on her behalf.

Does the DPDP Act have a category of sensitive personal data?

No. The Act defines only personal data. The sensitivity of the data processed is one of the factors the Central Government weighs when notifying a Significant Data Fiduciary under section 10.

When did section 2 of the DPDP Act come into force?

On 13 November 2025, in the first stage under notification G.S.R. 843(E). The obligations that use these definitions, sections 3 to 17 and the penalties, come into force on 13 May 2027.
